Terms of Service

These terms govern your use of MDSwap (the site at mdswap.vercel.app, including subdomains and any future custom domain). MDSwap is operated by an individual founder. Using the site means you agree to what's below. If you don't, don't use the site.

What MDSwap is

MDSwap is a directory of markdown files for AI agents — system prompts, skills, instructions, configs. You can browse and copy without an account. To publish, rate, comment, or report, you sign in. The service is free.

Eligibility

You need to be at least 13 (or the digital-consent age in your country, whichever is higher) to create an account. If you're under 18, you confirm a parent or guardian agreed to these terms on your behalf. We don't knowingly collect data from children below the digital-consent age; if you believe we have, contact us and we'll delete it.

Your account

You sign in with Google, GitHub, or an existing email/password (legacy only). One human, one account. You're responsible for what happens under your account, including content you publish and reports you submit. Don't share credentials. If you suspect compromise, change your password (or revoke OAuth) and tell us.

Your content

You keep your copyright. By publishing content on MDSwap you grant MDSwap a worldwide, royalty-free, non-exclusive license to host, display, transmit, cache, mirror in feeds and embeds, and use it to operate and promote the service. You can delete an MD any time; the license ends for new uses, but cached, archived, and embedded copies elsewhere may persist briefly.

Each MD carries a license you choose (MIT, Apache 2.0, CC0, CC-BY, or proprietary). Other users rely on that license. Don't lie about it. If you mark an MD CC0, treat it as released. If you mark it proprietary, others may still copy it for personal use; redistribution rights are what the license you picked says they are.

You represent that the content is yours, or you have rights to redistribute it under the license you chose. If your content was generated wholly or in part by an AI model, you confirm the model's terms allow redistribution under your chosen license, and you tag the MD with the AI-generated indicator (EU AI Act Article 50).

Acceptable use

What you may and may not do is in our Acceptable Use Policy and Content Policy. The short version: be useful, don't harass anyone, don't post things designed to extract real-world harm from a model, don't post copyrighted material you don't have rights to. We remove content that breaks those policies and may suspend or ban accounts for repeat or severe violations.

What MDSwap can do with reports

Anyone can report an MD. We read every report. We don't pre-moderate; we react. Decisions are made by a human (the founder, or a delegated moderator) using the criteria in the Content Policy. We aim to acknowledge reports within 72 hours and resolve within 7 days. CSAM and credible threats: same-day, with referral to NCMEC and law enforcement as required.

DMCA

Rights holders can submit notices. The full process and required elements are at /legal/dmca. Counter-notices are accepted. Repeat infringers lose their accounts.

Termination

You can delete your account from /me. We honor a 30-day grace period and email you an undo link; after that we hard-delete personal data per our Privacy Policy. We can suspend or terminate accounts that break these terms or pose risk to other users or the service. Where reasonable we'll tell you what and why; in clear-cut cases (CSAM, credible threats, court orders) we may act immediately and explain after.

Service availability

MDSwap is hosted on Vercel and Supabase. Uptime is best-effort. There is no SLA. We may change, suspend, or stop any feature; substantial changes get a heads-up where possible. Bug-for-bug compatibility is not promised.

Disclaimers

The site and the content on it are provided as-is and as-available. MDSwap does not endorse user content. Prompts and configs found on MDSwap may produce inaccurate, biased, harmful, or unsafe model output; you are responsible for evaluating before you use anything in production. We disclaim all implied warranties to the extent the law allows: merchantability, fitness for a particular purpose, non-infringement, and accuracy.

Liability

To the extent the law allows, MDSwap and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the site. Our total liability for any claim is capped at the greater of (a) what you paid us in the 12 months before the claim (so usually zero), or (b) US$100. Some jurisdictions don't allow these limits; in those, the limit is the minimum the law allows.

Indemnity

If your content or your use of the site causes a third party to bring a claim against MDSwap, you agree to defend and indemnify MDSwap against that claim, including reasonable legal fees, except where the claim is caused by our own negligence or breach.

Governing law and disputes

These terms are governed by the laws of the founder's jurisdiction, without regard to conflict-of-laws rules. Disputes go to the courts there. If you're a consumer in a country that gives you a non-waivable right to your local courts and law, that right applies. We'd rather you email us first; most things get sorted in a thread.

Changes

We may update these terms. Material changes get a notice on the site and an email to active accounts at least 14 days before they take effect. Continued use after the effective date is acceptance.
